RENTAL AGREEMENT

9477-3280 QUÉBEC INC., a company legally incorporated under the Quebec Business Corporations Act on October 21, 2022, registered in the Quebec enterprise registry under number 1178103348, with its registered office located at 446 Montrose Drive, Beaconsfield, Province of Quebec, Canada, H9W 1H3, acting and represented by JOANNA BIRECKA, President and Secretary, duly authorized as she declares.

Chalet Valhalla Saint-Côme Rental Agreement - By making your reservation, you (“guest”) confirm having read the regulations and conditions and agree to adhere to them in full during your stay at Chalet Valhalla Saint-Côme (“host”).

Check-in time: 5:00 PM or later. If you wish to arrive before 5:00 PM, please contact us on the morning of the reservation, and we can validate if the chalet is available earlier.

Check-out time: before 11:00 AM

THE PARTIES AGREE TO THE FOLLOWING:

1. Booking terms (if applicable)

  1. 50% of the rental fee is required at the time of booking. The balance of the rental fee is payable 14 days prior to the start date of the stay.
  2. If the booking is made less than 14 days before the start date of the stay, full payment is required at the time of booking.
  3. A security deposit of $1500 CAD will be taken 24 hours before arrival and released within 7 days after departure if no damage is found by the host.

2. Rental cancellation policy (if applicable)

  1. If the cancellation notice is received 14 days or more before the start date of the stay, 50% of the deposit will be retained by the host as damages.
  2. If cancellation is made less than 14 days before the start date of the stay, 100% of the deposit will be retained by the host as damages.
  3. If cancellation is made after the start date of the stay, the guest will be required to pay the full amount of the rental, except for the security deposit which will be returned, in the absence of damage.
  4. In the event that the stay has to be canceled or interrupted due to unforeseen problems with the building (water, electricity, etc.), the host's liability would be limited to the cost of the rental. Unused days would then be refunded, but no additional compensation will be granted.

3. Building regulations

  1. The guest must be aware of the instructions and regulations and communicate them to any other occupants.
  2. The interior of the chalet is non-smoking, which includes: cigarettes, cigars, cigarillos, vaping devices, cannabis, etc. In case of non-compliance, any additional cleaning required due to the presence of smoke will result in an automatic deduction from the deposit. Ashtrays are provided for the guest in outdoor areas and must be used to dispose of tobacco-related waste.
  3. No parties are allowed at the chalet. We have a zero-tolerance policy which will result in immediate expulsion from the property without refund.
  4. The guest agrees to adhere to reasonable rules of conduct and not to disturb the neighbors and residents of the area. The guest must maintain a reasonable noise level, both inside and outside the chalet. Noise is prohibited from 11:00 PM to 8:00 AM. Be aware that the municipality of Saint-Côme takes this very seriously. Garda services have been retained for short-term rental residences in its territory. Fines of up to $1,000.00 can be assessed for a first offense. If the host receives a notice of infraction dated during the guest's rental period, the guest must reimburse the host 100% of the amount of the infraction, plus fees, and the host reserves the right to terminate the rental period (without refund).
  5. The booking guest must be 25 years of age or older and must be present during the stay.
  6. The guest is responsible for the actions of all other occupants on the rental premises. Only registered persons who are included in the reservation are allowed to stay at the chalet. Please ensure that the exact number of people is reflected in your reservation request. Visitors must be approved in advance.
  7. The guest must notify the host of any damages as soon as discovered.
  8. The guest is responsible for material damages occurring in or on the rented building (including the land and outdoor equipment) during the rental period, for any reason whatsoever, except for damages resulting from construction defects, lack of maintenance, natural and technological disasters, and any damage normally covered by the host's home insurance policy. The guest agrees to indemnify and hold the host harmless from any claims presented by anyone resulting from damages for which they are responsible.
  9. The guest agrees to respect the rented premises and to return them in the same condition as upon arrival. Furniture and items available to the guest must be treated with care.
  10. A full cleaning of the property will be performed at the end of the stay only. However, the guest agrees to return the premises in the same state as upon arrival. If the cleaning team reports that the chalet was not left in a reasonably clean state, a minimum fee of $100.00 will be deducted from the deposit.
  11. The guest agrees to use only the rented premises and to respect the spaces of neighbors and residents of the area.
  12. Any defects noticed by the guest during the rental period must be reported at the time they are discovered. No compensation will be offered if you express a complaint after leaving the premises.
  13. Nothing should be thrown into the sinks, toilets, and bathtubs that could block the septic system; otherwise, the costs incurred for their repair will be charged to the guest.
  14. Playing "mini-hockey" in the chalet is prohibited.
  15. The guest must lock the doors and windows during their absence.

4. Important Conditions

  1. The guest agrees to abide by the establishment's regulations at all times. This commitment also applies to other occupants.
  2. The establishment can only be rented for vacation purposes.
  3. It is the guest's responsibility to respect the maximum number of occupants, which is 16 people (maximum 12 adults). Strict monitoring of the number of occupants is applied, and the tranquility of the premises must be respected at all times. Exceeding the maximum number of occupants will result in the automatic expulsion of the group without any compensation.
    *For the purposes of this agreement, any person aged 16 and over is considered to be an adult.
  4. The guest may not lend or sublet the chalet to a third party. They are solely responsible for the rental contract during the duration of the stay.
  5. If on the day of departure, the guest does not leave the premises at the time mentioned (as per the contract), additional fees may apply. Any guest still on the premises after 1:00 PM will be charged for an additional night.
  6. The guest is responsible for the chalet and its contents. Furthermore, they assume full and sole responsibility for other occupants to whom they allow access.
  7. The chalet is equipped with cameras outside the property near access entrances. The objective is to monitor during vacant periods, to monitor the number of occupants, and to ensure no animals are present. To respect the privacy of guests, cameras do not point towards the spa. It is forbidden to adjust the angle of the cameras or to disconnect them. This act will be considered an attempt to hide important elements from the host and, as a result, will immediately terminate the rental without refund.

5. Regulations Regarding Outdoor Fires

  1. Outdoor fires are allowed in the designated area. Before starting a fire, it is your responsibility to check the fire index in our region (Lanaudière/Matawinie). Please consult the SOPFEU website to ensure that the Stop Fire index in our area is blue or green. Do not light a fire if winds exceed 20 km/hour.
  2. The fire must be constantly supervised by the guest, and this person must be of legal age.
  3. The guest is responsible for the fire and must be prepared to take the necessary and appropriate measures to maintain control and to completely extinguish the fire before leaving the premises.
  4. It is strictly forbidden to burn anything other than cut wood and/or tree branches or fireplace wood.
  5. It is forbidden to fuel or maintain a fire with an accelerant.
  6. The municipality reserves the right to immediately extinguish any fire or to perform the extinguishment if it judges that the smoke, embers, sparks, inconvenience the neighborhood, if a complaint has been filed with the municipality, affects visibility on a public road, or if it judges that there is a risk to the safety of people or the integrity of neighborhood properties.
  7. The time for extinguishing fires is 11:00 PM. A hose is provided for extinguishing the fire.

6. Checklist Before Leaving the Premises

  1. In general, leave the chalet in good condition and return items to their original location. If additional cleaning is necessary, the amount will be deducted from the deposit.
  2. The guest shall dispose of garbage and recycling in the respective bins located on the roadside. The green bin is for household waste and the blue is for recycling.
  3. The guest agrees to empty both refrigerators and the cupboard. Do not leave any food after departure. Fees may be deducted from the deposit if this is not done.
  4. The guest agrees to wash dirty dishes or place them in the dishwasher and start it before leaving. Ideally, empty the dishwasher.
  5. The guest agrees to lock the doors and windows facing the outside.
  6. The guest agrees to place used towels/washcloths together on the floor next to the washing machine. Please leave the beds unmade.

7. General Provisions

  1. This short-term rental agreement can only be amended in writing.
  2. If any provision of this agreement is found to be null and void or unenforceable, the validity of the remaining provisions shall not be affected. In the case of an unenforceable provision, the parties shall reach an agreement that most closely approximates the economic objectives sought by the parties in this agreement.
  3. This document shall be governed and interpreted in accordance with the laws in force in the Province of Quebec and Canada.

8. Other Provisions

  1. The host assures that the rented establishment holds a classification certificate issued by the Quebec Tourism Industry Corporation in accordance with the law on tourist accommodation establishments and is still in force.
  2. The host cannot be held responsible for any accident, injury, or illness resulting from the fault of the guest, which may occur to the guest or occupants during the stay. By accepting this clause, the guest and their guests accept the risks associated with their stay at the establishment. Guests acknowledge that they may personally take out insurance to protect themselves against such events.
  3. The host cannot be held responsible for the theft or loss of the guest's or their occupants belongings during the stay.
  4. In the event of non-compliance with these rules by the guest or their occupants, the host reserves the right to terminate the rental contract and to expel the guest and their guests immediately. In such a case, the host will retain any sums that have been paid without any possibility of reimbursement.

9. Conditions concerning the Chalet's location and region and situations beyond our control

  1. The rental rate includes snow removal from the parking area. There is also a bin with an abrasive that you can spread in the parking area if it is slippery. Although the host has taken all necessary reasonable measures to make the place safe and easily accessible, the guest must understand that the chalet may be located in mountainous terrain and that Quebec is a northern geography. As such, they assume full responsibility.
  2. Under no circumstances will the host be held responsible for any problems related to the terrain's relief or weather conditions. This includes, among others, the state of roads, paths, or pedestrian accesses. All injuries following a fall or any other accident or damage to vehicles will be the responsibility of the guest. Any vehicle breakdown will be at the guest's expense.
  3. Ensure that you and your companions have vehicles that are properly equipped to deal with our region's weather conditions.
  4. The host cannot control and guarantee the electrical grid service and internet access. Power outages are quite rare, but they can occur at any time. The internet network is stable, but an outage could happen at any moment.

10. Spa Guidelines

  1. Never leave children alone in the spa.
  2. Never allow children to open the spa cover, or manipulate the screen or maintenance products.
  3. Do not bring glass bottles or food into the spa. Only cans and plastic glasses are permitted. Plastic glasses are available in the kitchen.
  4. To keep the water clean and for the proper functioning of the spa, please take a shower before using the spa.
  5. No baby diapers or Pull-Ups are permitted in the spa as the product used to make diapers/pull-ups will automatically require draining the spa. It is not recommended to put a baby and/or a young child in the spa due to the high temperature of the spa. If the water becomes cloudy, dirty, or green due to misuse, we will have to charge you fees to drain the spa.
  6. Always shake off your feet to avoid bringing sand or grass into the water.
  7. Regularly check the temperature and clarity of the water so we can intervene as quickly as possible in case of a problem. Keep the spa temperature at all times between 95 and 101 degrees F in summer and between 98 and 101 degrees F in winter.
  8. Always open the spa cover with two people, one on each side of the cover, gently, to avoid damaging the lever. Keep the cover vertical when open.
  9. The spa is programmed so that the filtration cycles start by themselves. Do not interfere with these cycles. Note that the spa can be used without a problem during filtration.
  10. Always turn off the water jets before closing the spa cover.
  11. Always close the spa cover after each use. This will prevent a child from accessing it without your knowledge and prevent the water from evaporating and damaging the spa pump.
  12. Once daily, following the last use, it is important to add a scoop of oxidizer to the spa.
  13. It is important not to remove the spa's floater.
  14. The spa water is tested before each rental and must be left as clean as at arrival. If it is necessary to change the water in the spa after your stay, fees will be withheld from the security deposit.
  15. Any breakage or damage to the spa will result in additional charges that will be deducted from the security deposit.
  16. Any malfunction of the spa must be reported immediately.

11. Water Activities

  1. It is prohibited to use the watercrafts provided without wearing an appropriately sized and well-fitted life jacket.
  2. Wearing a life jacket is mandatory at all times on the dock and in the watercrafts.
  3. Neither the host nor the municipality provides lifeguard services.
  4. Water activities are carried out at sole risk of the guest.

ARTICLE 11: OBLIGATION TO PROVIDE A LIST OF WATERCRAFT AVAILABLE TO GUESTS

When applicable, hosts must provide a list of watercraft available to guests and integrate this list into their rental regulations.

ARTICLE 13: PETS

Pets are under the responsibility of the rental respondent and must be kept on a leash or tied to a fixed point at all times when they are outside. Dogs must have a valid license from a competent authority. Under no circumstances can a tourist residence accommodate more than 4 dogs simultaneously.

* PETS ARE PROHIBITED INSIDE AND OUTSIDE THE CHALET.

ARTICLE 14: PROHIBITION OF MAKING NOISE THAT COULD DISTURB THE PEACE OF NEIGHBORS

It is strictly forbidden to produce or allow noise that could disturb the peace of a neighbor or the neighborhood.

ARTICLE 14.1: PROHIBITION OF USING FIREWORKS

It is forbidden for the guest or any occupant to use fireworks at any time.

ARTICLE 15: END TIME FOR OUTDOOR ACTIVITIES

At all times, guests of a tourist residence must cease any outdoor activity that could generate noise from 11:00 PM until 8:00 AM the following morning.

ARTICLE 16: CAMPING, TRAILERS, TENT TRAILERS, AND OTHER RECREATIONAL VEHICLES

It is strictly forbidden, when renting a tourist residence in the territory of Saint-Côme, to set up one or more tents, trailers, tent trailers, and other recreational vehicles on the rented land or any other nearby land. It is also prohibited to use accessory buildings for accommodation purposes.

ARTICLE 17: WATER ACTIVITIES AND WATERCRAFT

It is forbidden for any guest to launch a boat, dinghy, canoe, kayak, pontoon, or any other personal, rented, or borrowed watercraft into any body of water in the Municipality of Saint-Côme, except for watercraft provided by the host.
